  中国大地财产保险股份有限公司   船舶保险附加保险条款   1.船舶保险附加战争、罢工保险条款   一、责任范围   本保险承保由于下述原因造成保险船舶的损失、碰撞责任、共同海损和救助或施救费用:   (一)战争、内战、革命、叛乱或由此引起的内乱或敌对行为;   (二)捕获、扣押、扣留、羁押、没收或封锁,但这种赔案必须从发生日起满六个月才能受理;   (三)各种战争武器,包括水雷、鱼雷、炸弹;   (四)罢工、被迫停工或其他类似事件;   (五)民变、暴动或其他类似事件;   (六)任何人怀有政治动机的恶意行为。   二、除外责任   由于下列原因引起保险船舶的损失、责任或费用,本保险不负责赔偿责任:   (一)原子弹、氢弹或核武器的爆炸;   (二)由保险船舶的船籍国或登记国的政府或地方当局所采取的或命令的捕获、扣押、扣留、羁押或没收;   (三)被征用、征购或被出售;   (四)联合国安理会常任理事国之间爆发的战争(不论宣战与否)。   三、保险终止   (一)保险人有权在任何时候向被保险人发出注销本保险的通知,在发出通知后7天期满时生效;   (二)无论是否已发注销通知,本保险在下列情况下应自动终止;   1、任何原子、氢弹或核武器的敌对性爆炸发生;   2、联合国安理会常任理事国之间爆发的战争(无论宣战与否);   3、船舶被征用或出售。   四、承保原则   (一)本保险系《船舶保险条款》(以下简称“主险”)的附加险。主险的条款也适用于本附加险,但主险条款与本附加险条款有抵触时,以本附加险条款为准。   (二)保险船舶如同时有其他保险,任何索赔应由其他保险公司负责时,本保险不负赔偿责任。   (三)如本保险由于第三条原因终止时,净保费可按日比例退还给被保险人。本保险不办理停泊退费。   2.船东保障和赔偿责任险条款   本保险条款是船舶保险的附加综合保险条款。   第一节 承保原则   中国大地财产保险股份有限公司(以下简称“保险人”)按下列原则承保船东保障和赔偿责任。 (一) 保险合同订立前,被保险人应当将其知道的或者在通常业务中应当知道的有关影响本公司据以确定保险费率或者确定是否同意承保的重要情况,如实告知保险人。   (二) 被保险人在投保时必须以书面形式填写保险人制定的投保单,并将船舶的船名、船龄、船旗、船级、类型、注册地、航线及船舶规范证书,船东和经营人的名称及其所在地告知保险人。   如果被保险人在投保时因为时间紧迫未按上述要求告知上述有关事项,被保险人必须在投保前征得保险人的书面同意,并在投保后15天内以书面形式将该事项告知保险人。如上述要求告知的事项在承保期间内发生变化,被保险人应在变化发生3天内以书面形式通知保险人,保险人将有权决定是否继续承保,否则,保险人有权按本条款第六节第三条第二款“终止”的规定进行处理。   违反本款规定,本合同自动终止,保险人有权决定收取因此发生的手续费和决定手续费的金额。 (三) 在保险期间内,保险人有权随时委请验船师对被保险船舶进行检验,被保险人必须提供便利,并保证按照保险人在检验后提出的建议,在要求的期限内消除缺陷,否则保险人将对此缺陷引起的索赔不负赔偿责任或终止本合同,并不退还所缴纳的保险费。 (四) 被保险人投保时要按保险人规定的日期交付保险费。逾期不付的,保险人有权自承保时起解除本合同的赔偿责任并有权收取因此发生的手续费和决定手续费的金额,除非该延期支付事先征得保险人的书面同意。   (五) 本保险适用于《中华人民共和国海商法》和与此有关的法律规定。   第二节 定义 (一) 保险人指中国大地财产保险股份有限公司。 (二) 油指任何种类的油料,包括任何含油成份的混合物。   (三) 有害物质指①已被任何政府,当局或任何官方的国际组织列为危险物质或污染物质的任何物质或其中一个类别或任何成份或合成物(油料除外);②保险人认定的对人的健康或公众福利、财产、动物、植物或海生物、环境或可能对上述任何事项造成严重影响或构成威胁的物质。 (四)《海牙规则》指1924年8月25日在布鲁塞尔签订的《关于统一提单的某些法律规定的国际公约》。 《海牙—维斯比规则》指1968年2月23日在布鲁塞尔签订的《关于修订统一提单某些法律规定的国际公约议定书》。 (五) 船员指被保险船舶所雇佣的,为该船服务并属该船正常编制内的人员。   船员以外的任何人员指被保险船舶上的,非该船雇佣的并且不参加船舶营运的人员。 (六) 登记总吨指船舶登记证书上注明的该船舶的总登记吨位。   第三节 承保风险 保险人根据本附加险约定承担被保险人依法应承担的以下责任、损失和费用: (一) 人身伤亡和疾病——船员以外的任何人 1、由于被保险船舶或与该船舶有关的过失或疏忽行为引起在该船舶上的任何人员的人身伤亡或疾病的损害赔偿责任以及由此支付的合理的医药、住院或丧葬费用; 2、根据合同或协议规定对任何人员的人身伤亡或疾病应负的赔偿责任以及由此伤亡或疾病而支出的合理的医药、住院或丧葬费用,但此类合同或协议必须事前得到保险人的认可,并已由被保险人与保险人就赔偿责任达成协议。   (二) 人身伤亡和疾病——船员   1、对被保险船舶船员的人身伤亡、疾病的损害赔偿责任以及由此产生的合理的医药、住院或丧葬费用。 2、根据合同或协议规定对船员的人身伤亡或疾病应负的赔偿责任以及由此产生的合理的医药、住院或丧葬费用,但此类合同或协议必须事先得到保险人的认可并已由被保险人与保险人就赔偿责任达成协议。 注:本款项下的人身伤亡赔偿金额以本“条款”第四节的规定或以保险双方在投保时商定的赔偿限额为限。   (三) 被保险船舶船员的遣返   由于被保险船舶船员的人身伤亡或疾病,或根据法定义务,或由保险人认可的船员雇佣合同或其他劳务合同而产生的被保险船舶船员的遣返费用及替工的派遣费用,但不包括因以下原因产生的费用: 1、合同终止,无论该终止是因合同规定或根据船东和船员的双方协议;   2、船舶出售; 3、船东违反船员雇佣合同或其他有关的服务合同或协议; 4、船东所采取的与被保险船舶有关的任何其他行为。   (四) 私人物品 1、被保险船舶船员的私人物品因被保险船舶发生海上事故而遭受的损失或灭失,但这种私人物品仅指船员生活的必需品,不包括现金、有价证券、票据、饰物、贵重或稀有金属、珠宝、艺术品、电器及其他贵重物品。 2、由于被保险人或被保险船舶的船员或其他人员的过失或疏忽造成该船舶上的旅客的行李或物品的损坏或灭失的应负赔偿责任,但这种责任不对旅客的现金、有价证券、票据、饰物、贵重或稀有金属、珠宝、艺术品、稀有贵重等物品负责。 3、因某合同条款所产生的上述赔偿责任,且若无此条款就不会产生该赔偿责任。该合同条款须经保险人书面认可,并以这种认可的范围为限,否则保险人将不承担该赔偿责任。   (五) 因被保险船舶失事引起的赔偿 根据法定义务或根据有关的劳务或雇佣合同或协议条款的规定,被保险船舶应向船员支付因该船舶实际全损或推定全损导致船员失业而且不能从任何方面得到的失业工资补偿,但上述条款须经保险人的书面确认并仅以此确认的补偿范围为限。   (六) 绕航 因被保险船舶上的船员发生疾病、受伤或死亡,需要进行必要的治疗或处理或必须更换船员,或为把偷渡者或避难者送上岸而发生的合理绕航费用,但这种费用仅限于额外产生的港口费用、伙食、物料、燃油、保险费及船员工资和津贴。   (七) 安置偷渡者和避难者 除上述第六款承保的费用外,被保险船舶根据法律规定或经保险人认可,为安置偷渡者或避难者所产生的任何费用。   (八) 救助人命 因第三者对被保险船舶船上人员进行救助或被保险船舶的人员进行自救,依据法律应由被保险人向该第三者支付的费用,但这种费用必须是不能从被保险船舶的船舶保险人、货主或货物保险人处得到赔偿的费用。   (九) 碰撞责任 被保险船舶与他船碰撞产生的下列责任和费用,但这种责任和费用仅限于该船舶的船舶保险单中的碰撞责任条款所不承保的责任和费用: 1、打捞、清除、拆毁障碍物、船舶残骸、货物或其他物品以及由此所产生其他有关费用; 2、人身伤亡或疾病引起的医药费、丧葬费及其他有关费用; 3、任何财产(不包括与被保险船舶碰撞的他船及他船上的财产)或物品的污染或沾污; 4、除上述第1、2、3、项外,被保险船舶因碰撞所承担的责任赔款由于超过船舶保险单的保险金额、而不能从船舶保险人得到赔偿的那部分超出责任,但保险人仅对该船舶按实际价值足额投保船舶险而超出的部分负责; 5、其他: (1)除另有约定外,被保险人不得向保险人索赔在船舶险保险单免赔额项下规定的应由其自己承担的绝对免赔额或相对免赔额。 (2)如同属同一被保险人的船舶发生碰撞,被保险人可按上述规定向保险人索赔,保险双方的权利和义务就如同两船分属不同的船东一样。 (3)如碰撞船舶双方互有过失,除非一方或双方根据法律可限制责任,本条项下的索赔按单一责任原则赔付外,双方的赔偿责任应按交叉责任划分,即双方船东按碰撞责任的比例确定各自的赔款金额并相互冲抵后应赔付对方的损失。 注:本款项下的与任何污染及人身伤亡有关的赔偿以本“条款”第四节的规定或以保险双方在投保时商定的赔偿限额为限。   (十) 财产的损坏或灭失 不论在陆地或水上,也不论是固定或移动的任何财产的任何损坏或灭失的赔偿责任。但这种责任不包括: 1、根据被保险人与第三方订立的任何合同或协议条款所产生责任; 2、应由被保险人承担的船舶保险单规定的绝对或相对免赔额; 3、按本节下述各条款已承保的责任或损失 第四款——私人物品 第九款——碰撞责任 第十一款——污染 第十二款——拖带责任 第十三款——残骸消除责任 第十五款——提单项下的货物责任 第十六款——被保险船舶的财产 如被保险船舶对被保险人的财产或权益造成损害、损坏或侵犯,被保险人具有从保险人取得赔偿的权利,就如同该财产或权益属于不同的船东一样。 注:本款项下的任何与污染有关的赔偿以本“条款”第四节的规定或以保险双方在投保时商定的赔偿限额为限。   (十一)污染 由于被保险船舶的油或其他有害物质的排放或泄漏,或由于存在这种威胁而产生的下列责任、损失、损害或费用:   1、损失、损害或污染的责任;   2、船东作为《油轮所有人自愿承担油污责任协议(TOVALOP)》及其补充规定或保险人认可的其他协议的参加者,根据上述协议所应承担的损失、损害或费用,包括船东为执行上述协议规定的义务而产生的费用;   3、为避免或减轻污染及其结果造成的损失或损害而采取合理措施所产生的费用,以及因采取这种措施而造成财产的损失或损害应负的责任;   4、为防止被保险船舶面临排放或泄漏油或其他可能造成污染的物质将出现的危险局面而采取合理措施所产生的费用;   5、服从任何政府或有关当局为防止或减轻污染或污染风险发出的命令或指示而产生的费用或责任,但这种费用或责任以不能从被保险船舶的船舶保险单得到赔偿为限。   注:本款项下的任何与污染有关的赔偿以本“条款”第四节的规定或以保险双方在投保时商定的赔偿限额为限。   (十二) 拖带责任 1、根据拖带合同,被保险船舶在正常营运期间,由拖轮拖带进出港口或在港内移动所负责的而且不能从船舶险保险单取得赔偿的责任。 2、根据拖带合同被保险船舶由拖轮进行本款第1项规定以外的非常规拖带所负责的责任,但这种责任的赔偿仅以保险人事先认可的责任范围为限; 3、被保险船舶对其他船舶或物体进行拖带的责任,但这种责任的赔偿仅以保险人事先认可的责任范围为限。 注:本款项下的任何与污染有关的赔偿以本“条款”第四节的规定或以保险双方在投保时商定的赔偿限额为限。   (十三) 残骸清除责任 被保险船舶在承保期间因发生海上事故(不包括船舶战争险所规定的责任范围内的事故)成为残骸,并且船舶保险人宣布不接受船舶残骸的委付。保险人自此终止本“条款”项下对其他承保风险的责任,但仍继续对被保险人为处理该残骸而产生的下列责任或费用负责: 1、根据法律或规定,对残骸及对其装载货物和财产进行强制起浮、移动、清除、拆毁及设置照明、标记等发生的费用,以及为此而产生的被保险人应负的责任; 2、由于残骸(或其装载的货物和财产)的存在或被强制移走,或由于被保险人未能起浮、移动、清除、拆毁该残骸或对其设置照明及标记而产生的责任,包括因该残骸的铀或其他有害物质的排放或泄漏所产生的责任。 但是: (1)在本条项下的赔偿应首先扣除被保险船舶的残骸本身及获救的残骸上的物料或货物价值以及被保险人在救助中获得的报酬; (2)被保险人在对上述船舶的残骸及货物或财产的起浮、移动、清除、拆毁及设置照明或标记以及出售或转让残骸前须事先得到保险人的书面同意,否则保险人将不对上述责任和费用负责; (3)如残骸或货物及财产的上述责任是根据合同或协议条款产生的,且若无此条款不会产生上述责任,此类合同或协议条款须事先得到保险人书面认可,否则保险人将不对上述责任和费用负责。 注:本款项下的任何与污染有关的赔偿以本“条款”第四节的规定或以保险双方在投保时商定的赔偿限额为限。   (十四) 检疫费用 因被保险船舶上发生传染性疾病而产生的额外费用,包括检疫和消毒费用及其他额外的燃料、保险、船员工资、津贴、伙食、物料和港口费用。   (十五) 提单项下的货物责任 1、货物的灭失、短少或其他责任 因被保险人或被保险人应对其行为、疏忽或过失在法律上负责的任何人未按提单规定克尽职责,违反妥善地装载、收受、积载、运输、保管、照料、卸载或交付货物的义务,或因被保险船舶不适航或不适货造成货物的灭失、短少、损坏所应承担的赔偿责任。 2、残损货物的处理 被保险人为卸下或处理残损货物而发生的额外费用,但仅以被保险人无法向任何其他方取得赔偿的费用为限。 3、收货人未能提走货物 被保险人因收货人未能在卸货港或货物交付地提取货物而使被保险人产生额外的责任和费用(即超出收货人正常提取货物所应支付费用的部分),但这种责任或费用仅以超过出售或拍卖这些货物的收入而且被保险人无法从任何其他方取得赔偿的部分为限。 4、联运或转船提单 被保险船舶因承担了以联运或转船提单运输货物的其中部分货物转船的运输所发生的,应由被保险船舶承担的货物灭失、短少、损坏或其他的赔偿责任。 但是: (1)被保险船舶根据上述提单进行运输时,其对货物的赔偿责任仅适用于《海牙规则》或《海牙—维斯比规则》的规定,除非保险人另有决定; (2)因被保险船舶绕航导致被保险人丧失根据《海牙规则》或《海牙—维斯比规则》应享有的权利而对货物产生的责任或费用,保险人不予负责,除非保险人另有决定; (3)除被保险人与保险人另有约定外,对装载于甲板上的任何货物的灭失或损坏不予负责,除非该货物适于装载于甲板上并在提单上注明,该货物装载于甲板上并且规定被保险人对该货物的灭失或损坏不负责任或规定被保险人的赔偿责任适用于《海牙规则》或《海牙—维斯比规则》的规定; (4)除被保险人与保险人另有协议,保险人对下列原因引起的责任和费用不负责任: ①被保险人或船长已明知装载的货物与提单或其他运输合同载明的货物情况不符,仍签发提单或其他运输合同; ②未将货物卸在运输合同规定的港口或地点;   ③以转让提单或其他类似运输合同承运的货物,未凭正确背书的提单交付货物;   ④签发预借或倒签提单;   ⑤被保险船舶未到或迟到装货港或未将已订舱的货物装上船;   ⑥被保险人或被保险船舶上的船长或大副签发的提单或其他运输合同载明的货物数量多于他们所知的已经托运或装船的数量的货物短卸; ⑦提单或其他运输合同的签发含有欺诈性的误述; ⑧以不可转让提单或其他类似运输合同承运的货物未交付给托运人指定的收货人; ⑨被保险人有意违反运输合同。 (5)从价货物 除被保险人与保险人另有约定之外,保险人对提单上申报的每件货每一计费单位或每一包装超过2500美元或等值货币的从价货物的赔偿以不超过2500美元为限。 (6)稀有或贵重货物 保险人对任何与承运稀有或贵重货物包括货币、贵重金属、宝石、贵重艺术品、债券或其他流通或有价证券等有关的赔偿责任不予负责。 (7)被保险人的财产 如被保险船舶上的灭失或损坏的货物系被保险人的财产,被保险人仍有权根据本“条款”有关规定从保险人取得赔偿,其权利如同该货物属于第三方一样。 (十六) 被保险船舶上的财产 被保险船舶上的任何集装箱、设备、燃料或其他财产的灭失或损坏应负的责任。 但是: 1、上述财产不属于本“节”第三节第四条(私人物品)或第十五条(提单项下的货物责任)所规定的范围; 2、上述财产不构成被保险船舶的一部分,也不由被保险人或与其联营的公司或与其同属一个管理人的公司所拥有或租用; 3、如果上述财产的责任是根据某合同或协议的条款产生,且若无此条款不会产生这种责任,此类合同或协议条款事先须得到保险人书面认可,否则保险人将不对这种责任负责。 (十七) 无法收取的共同海损分摊 被保险人因违反运输合同,不能向货方或其他利益方收取的共同海损分摊费、特别费用或救助费用。 本节第十五款(提单项下的货物责任)的所有规定都适用于本条项下的任何索赔。   (十八) 由船方承担的共同海损分摊 由于确定的共同海损、特别费用或救助费用分摊的船舶完好价值高于其船舶险保险单的保险金额,船舶保险人根据保险单不予负责的共同海损、特别费用或救助费的分摊部分。但如果被保险船舶的保险金额低于投保当时的船舶实际价值,保险人仅对以船舶实际价值作为船舶险保险金额且船舶险保险人不予负责的分摊部分进行赔偿。   (十九) 罚款 仅由于下列原因产生任何法院、法庭或有关当局根据所在国法律或有关规定对被保险船舶或船员的罚款(对船员的罚款仅限于被保险人根据法律对船员应承担的罚款): 1、违反有关法律或规定未能提供或保持安全的工作场所或条件; 2、短卸、溢卸货物或未遵守有关物品申报或提供有关船舶及货物文件的规定; 3、违反海关规定; 4、违反移民法规; 5、油或其他危险物质的排放或泄漏所造成的污染; 6、除上述第1项至第5款规定外的船员或船舶代理人在履行其职务时的疏忽或过失。   但在任何情况下,保险人对被保险船舶或船员走私或被保险船舶超载的罚款不予赔偿。 (二十) 对救助人的特别补偿 为防止或减少环境损害,应由被保险人向被保险船舶的救助人所做的工作或采取的措施支付特别补偿的责任。但是,这种责任仅限于1990年劳合社救助合同标准格式或保险人认可的其他救助合同标准格式的条款所规定的责任范围,并且这种责任以不能从获救财产的利益方得到赔偿为限。 (二十一) 海事调查 在正式调查被保险船舶所涉及的损失或海事之前,被保险人为抗辩或为保护自身利益所发生的费用,但这种费用的支付范围和条件要由保险人决定。 (二十二) 施救和法律费用 1、在海上事故发生时或发生后,被保险人为防止或减少保险人全部或部分承保的责任或费用,而额外支出的合理费用; 2、被保险人为保险人全部或部分承保的责任或费用而支付的有关法律诉讼费用。 但是: (1)上述费用的支出应事先得到保险人同意; (2)如因扣除免赔额或其他原因保险人仅负责被保险人对第三者的部分赔偿,保险人将按此比例赔偿上述费用。 (二十三) 对救助人的特别保险 对专门从事海上救助的拖轮或其他船舶的船东的保险,保险人将根据该船东的要求,对因进行海上救助可能产生的有关责任、罚款、损失或费用的赔偿提供特别补偿。但是:   1、除非另有明确规定,本“条款”所载明的保证、条件、责任免除、赔偿责任限制和其他规定将适用于本款; 2、被保险人须在保险开始前和此后每一保险年度开始前三十天向保险人提出此保险申请。   第四节 保证、条件、责任免除、赔偿责任限制及其他   (一) 保证 被保险人保证在本保险有效期内保持经保险人在船舶投保时认可的船级。被保险船舶发生可能影响船舶适航的损坏时,应立即通知船级社,并及时遵守、执行和满足船级社的规范、规定、要求、限制或建议的内容或条件。 在保险有效期内,被保险人必须将船舶将要变更船级,以及至变更日时止被保险船舶尚存在、有未执行的原船级社的对其提出有关要求、限制或建议的情况,立即通知保险人。   (二) 免赔额   除另有约定,保险人将按以下金额对被保险人提出的下列事故的索赔扣除免赔额:   1.船员疾病:每一港口   2.私人物品:每次事故   3.货物:每次事故   4.罚款:每次事故   (三) 赔偿责任限制   保险人将按约定的最高赔偿金额对被保险人提出的事故索赔限制赔偿责任: 但是: 1.如因被保险人的过失或疏忽未采取必要的手段或措施限制其赔偿责任,保险人对被保险人的赔偿以其应享受的赔偿限制金额为限; 2.如被保险人是期租船承租人,保险人对该被保险人的赔偿责任以该船的注册船东依法能限制的责任为限。 注:保险人将有权随时修订上述责任限制金额,该修订将以书面形式通知被保险人并按通知所规定的期限生效。 (四) 先决条件   保险人赔偿被保险人根据本“条款”提出索赔的先决条件是被保险人必须: 1、按照保险人的规定交付全部保险费。如保险人放弃这一条件,保险人有权将应付给被保险人的任何款项冲抵被保险人应交付的保险费; 2、先行支付任何责任赔款、费用或开支,除非保险人另有决定。   (五) 责任免除   保险人在任何情况下将不对由于下列原因引起的任何责任、损害、损失或费用负责: 1、战争、内战、革命、叛乱、骚乱或由此引起的内乱或任何交战国之间的敌对行为;   2、捕获、扣押、羁留或没收(船员的不法行为或海盗除外)及由此引起的结果;   3、水雷、鱼雷、炸弹、火箭、炮弹、爆炸品或其他类型武器(因被保险船舶运输此类武器而产生的责任或费用除外); 注:由于政府命令或经保险人同意为防止或减少保险人承保的责任或费用而使用上述武器产生的责任、损失或费用除外。   4、任何核燃料、放射性制品、核废料、核装置或核武器的污染、辐射、泄漏、沾染等产生的责任、损失或费用,但对于装载于被保险船舶作为货物承运的供工业、农业、商业、医学或科学上使用的上述物质产生的责任、损失或费用除外;   5、被保险船舶承运违禁品、偷越封锁线、从事非法贸易,以及保险人根据有关全部情况认为该船舶所进行的或与该船舶有关的任何不谨慎、不安全或不适当的运输、贸易、航程或其他活动;   6、被保险人的任何故意行为;   7、被保险人根据本“条款”提出索赔的任何利息及船期损失; 8、被保险船舶的任何损失或损坏;在被保险船舶上属于被保险人拥有的设备或由与其联合的公司与其同属一个管理人的公司拥有或租用的任何财产损失或损坏;   9、任何运费、租金或租约取消的损失和滞期费的索赔;   10、任何为被保险船舶提供救助而产生的救助费用或其他费用,以及被保险船舶对他船进行救助或拖带产生的任何损失;   11、任何船舶险保险单承保风险所列的责任和费用。 注:上述第7、8、9和10项的责任免除不影响被保险人根据本“条款”第三节第(六)款(绕航),第(八)款(人命救助),第(十七)款(无法收取的共同海损分摊),第(十八)款(由船东承担的共同海损分摊),第(二十)款(对救助人的特别补偿)和第(二十二)款(施救和法律费用)对保险人提出的索赔。    第五节 被保险人义务 (一) 被保险人义务 1、通知 (1)被保险船舶一旦发生保险人承保责任范围内的事故,或发生可能会使保险人承担赔偿责任或费用的事故、事件或事项,被保险人应立即通知保险人; (2)被保险人必须立即将与上述(1)项所述的事故、事件或事项有关的每次检验或检验时机通知保险人; (3)被保险人必须在任何时间将其所获知的或掌握的与上述(1)项所述的事故、事件或事项有关的任何情况、文件或报告迅速通知保险人,并允许保险人及其代理人对上述事故、事件或事项向被保险船舶船员及被保险人雇用的任何人员进行调查。 2、施救 被保险船舶发生意外事故,被保险人及其雇员和代理人应如同未保险的船东一样采取合理谨慎的措施以防止或减少保险人承保的费用或责任,否则保险人将不承担任何因上述事故引起的赔偿责任,或对由于被保险人违反该义务而造成的损失扩大部分予以扣除。 被保险人如未履行上述第1款和第2款规定的义务,保险人有权对被保险人根据本“条款”承担责任提出的索赔不承担赔偿责任或扣减赔款,扣减赔款的数额由保险人决定。 (二) 律师和其他人的雇用 发生与本节第(一)条第1款第(1)项所述的任何事故、事件或事项时,保险人有权代表被保险人指定或雇用律师、检验人或其他人。被保险人在征得保险人的同意下,也可指定或雇用律师、检验人或其他人。 (三) 委付 如被保险船舶发生实际全损或船舶保险人同意该船舶作为推定全损,在不妨碍船舶保险人对此事的合法权益的前提下,保险人有权要求被保险人把该船舶委付给保险人或保险人指定的其他人。   第六节 保险起讫 (一) 保险期限 保险人规定的保险期限为一年。   (二) 保险费计算   年度保险费的计算为船舶总吨位与保险费率之积。   (三) 保险终止   1、通知 (1)被保险人可在保险年度结束三十天前书面通知保险人终止被保险船舶的保险,保险人也可根据同样的条件向被保险人发出同样的通知; (2)被保险人不得于上述本款第1项规定以外的任何时间或方式终止被保险船舶的保险。但是,该船舶发生本条第2款“终止”第(2)项的情况,被保险人可按本款第(1)项规定终止该船舶的保险。保险人将按日比例退还未到期的保险费。如果该船舶在保险期间发生的索赔超过其全部交付的保险费,保险人不再办理退费。 2、终止 如被保险人或被保险船舶发生下述任何事件或情况时,保险人即予以终止保险人为被该船舶承担本“条款”第三节承保的任何责任和费用,但对在终止保险之前已发生的承保责任或费用仍继续负责: (1)被保险人停业或破产; (2)被保险船舶已出售、转让、光船出租、抵押,以及经营权的变更,除非保险人书面同意; (3)被保险船舶的灭失,或经船舶保险人接受为实际全损或推定全损,或保险人船舶险保险单规定的船舶失踪; (4)船旗或船级社的变更或被保险船舶在保险期限内未能保持保险人同意的船级,除非保险人书面同意。   因上述原因发生本保险的终止,保险人不退还被保险人已交付的保险费,如有未交足年度保险费的还须补交。   第七节 争议处理   被保险人和保险人之间所发生的一切争议或纠纷,除双方另有约定外均由中华人民共和国的法院或仲裁机构依据中国法律解决。   第八节 其他事项   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   3.船东对第三者伤亡责任保险条款   本条款为《船舶保险条款》的附加险条款。只有在投保了船舶保险条款的基础上,方可投保本附加险。   一、保险责任   1.保险船舶因在航行或停泊中导致或引起除投保人、被保险人及本船雇用船员以外的任何第三者死亡或身体受伤而可能招致的任何法律责任,依法应由被保险人(即船东)承担的医疗费、住院费和伤残、死亡补偿费,保险人按照本合同的约定负责赔偿。   2.经保险人事先书面同意,对应由被保险人支付的仲裁或者诉讼费用以及其他法律费用,保险人负责赔偿,赔偿的数额在保险单载明的责任限额以外另行计算,最高不超过责任限额的20%。   二、责任免除   1.战争、敌对行动、军事行为、武装冲突、罢工、骚乱、暴动、恐怖活动及核辐射、核爆炸、核污染及其他放射性污染所致的任何人伤残或死亡;   2.殴斗、自杀、自残、疾病、违法犯罪行为所致的任何人伤残或死亡;   3.被保险人所雇用的任何人在其受雇工作期间因工所致的伤残或死亡;   4.投保人、被保险人(即船东)的故意行为所致的任何人伤残或死亡;   5.任何人的工资、奖金、补助等;   6.同一宗事故所引致的任何一宗意外或连串意外的、并超出本保险单列明责任限额的法律责任;   三、保险期间   保险期间为一年,起止日期以船舶保险单载明的时间为准。   四、责任限额及保险费   1.在保险期间内,保险人在本附加险项下对每次及多次事故承担的最高赔偿责任均以保险单载明的责任限额为限。   2.保险费率为年度费率,保险期限不足一年者,保险费按沿海内河船舶险短期费率表计收。   保险费=第三者人身伤亡责任保险责任限额×费率   3. 除另有约定外,投保人应按照保险合同的约定一次性交清保险费。   投保人未按照保险合同的约定及时足额交付保险费的,保险人可解除保险合同,保险合同自保险人解除保险合同的书面通知送达投保人时解除,保险人有权向投保人收取保险责任开始时至保险合同解除时期间的保险费。   五、赔偿处理   1.发生保险责任范围内的事故,被保险人必须于48小时之内将详情通知保险人。   2.发生保险责任范围内的事故,被保险人可以自行聘律师或其他人处理,也可以委托保险人指定或雇用律师或其他人处理。   4.错误,遗漏及误述条款   本保险单项下的赔偿责任不因被保险人非故意地疏忽或过失而延迟或遗漏向保险公司申报被保险船舶风险状况及变更而受拒付。但被保险人一旦明白其疏忽或遗漏,应即向保险公司申报上述情况,否则保险公司不负赔偿责任。   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   5.保单注销条款   保险人可以提前60天通知被保险人注销本保险单,在此情况下,保险人应将按日比例计算的自保险单注销之日起的未到期保险费退还给被保险人。   被保险人可以随时通知保险人注销本保险单,在此情况下,保险人按日费率收取自保险单开始之日起的已生效保险费。   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   6.损失检验与理算条款   发生保险事故后,保险双方对事故认定、损失金额存在分歧时,保险公司同意聘请双方认可的保险公估公司或其他专业机构进行损失检验与理算,保险公司承担相应费用。   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   7.预付赔款条款(50%)   发生事故后,经查勘属于保险责任,估计损失金额超过人民币万元时,经被保险人申请,保险公司应在7个工作日内支付保险责任项下估损金额50%的预付赔偿金。   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   8.拖船拖缆、索具以及起重船、工程船或浮吊的吊索具损失条款   拖船配备的从事拖带作业所用拖缆及拖带索具以及起重船、工程船或浮吊的吊索具属于承保范围,当因本保险承保风险导致拖缆、拖带索具以及吊索具的损失,本保险负责赔偿。损失包括但不限于拖缆、拖带索具、吊索具的断裂、强度失效致使无法继续从事相关作业等情况。   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   9.引水免责条款   被保险人和/或租船人依照当地法律法规或惯例,或被迫接受免除或限制引水员和/或拖轮及其船东赔偿责任相关条款时,保险人对被保险人的保险赔偿不受影响。   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   10.直升机运送许可条款   通过直升机向被保险船舶运送船员、引水员、检验人、维修件及其它、货物、邮件、存货、设备等类似行为,不影响本保险效力。   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   11.核辐射污染、化学、生物、生化及电磁武器除外条款(CL370)   本条款为首要条款,本保险中任何与本条款不一致的约定,应以本条款为准。   在任何情况下,本保险对直接或间接由下列原因造成的或导致的或引起的损失、损坏、责任或费用不承担赔偿责任:   1.1 由任何核燃料、核废料或核燃料的燃烧或反应所造成的离子放射或放射性污染;   1.2 任何核装置、核反应堆或其它核燃料及任何核部件所具有的放射性、毒性、爆炸或其它危险因素或污染性;   1.3 任何利用原子或核裂变和/或核聚变及类似反应或放射性能量或物质的武器或装置;   1.4 任何放射性物质所具有的放射性、毒性、爆炸或其它危险因素或污染性。   本补充条款之责任免除并不包括非用作核燃料而正处于准备、运输、储存过程中或用于商业、农业、医疗、科研或其他类似和平目的的非核燃料放射同位素;   1.5 任何化学、生物、生化或电磁武器。   INSTITUTE RADIOACTIVE CONTAMINATION, CHEMICAL, BIOLOGICAL,BIOCHEMICAL AND ELECTROMAGNETIC WEAPONS EXCLUSION CLAUSE (CL370) 10/11/03   This clause shall be paramount and shall override anything contained in this insurance inconsistent therewith   1.1 In no case shall this insurance cover loss damage liability or expense directly or indirectly caused by or contributed to by or arising from   1.2 ionising radiations from or contamination by radioactivity from any nuclear fuel or from any nuclear waste or from the combustion of nuclear fuel   1.3 the radioactive, toxic, explosive or other hazardous or contaminating properties of any nuclear installation, reactor or other nuclear assembly or nuclear component thereof   any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter   1.4 the radioactive, toxic, explosive or other hazardous or contaminating properties of any radioactive matter. The exclusion in this sub-clause does not extend to radioactive isotopes, other than nuclear fuel, when such isotopes are being prepared, carried, stored, or used for commercial, agricultural, medical, scientific or other similar peaceful purposes   1.5 any chemical, biological, bio-chemical, or electromagnetic weapon.   12.计算机攻击除外条款(CL380)   本附加险条款与主险条款不一致之处,以本附加险条款为准;本附加险条款未尽之处,以主险条款为准。   1.1 除遵照1.2款外,本保险在任何情况下对直接或间接由于对计算机、计算机系统、电脑软件程序、恶意代码、电脑病毒或其它电子系统的恶意使用或操作所造成的或导致的或引起的损失、损坏、责任或费用不负责赔偿;   1.2 在保单批注承保战争、内战、革命、叛乱、起义或者由此引起的内乱或交战方的敌对行为或恐怖活动或任何人怀有政治目的的恶意行为的风险下,1.1款并不免除应用于武器或导弹的发射、制导或火控系统中的任何计算机、计算机系统、电脑软件或其它类似电子系统所造成的保险损失。INSTITUTE CYBER ATTACK EXCLUSION CLAUSE (CL380) 10/11/03   1.1 Subject only to clause 1.2 below, in no case shall this insurance cover loss damage liability or expense directly or indirectly caused by or contributed to by or arising from the use or operation, as a means for inflicting harm, of any computer, computer system, computer software program, malicious code, computer virus or process or any other electronic system.   1.2 Where this clause is endorsed on policies covering risks of war, civil war, revolution, rebellion, insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power, or terrorism or any person acting from a political motive, Clause 1.1 shall not operate to exclude losses (which would otherwise be covered) arising from the use of any computer, computer system or computer software program or any other electronic system in the launch and/or guidance system and/or firing mechanism of any weapon or missile.   13.船舶营运费用和增值保险   一、航行   1、保险船舶在任何时候按本保险的各项规定承保,允许在有或没有引航员的情况下开航或航行、试航、和协助、拖带遇难船舶,但保证保险船舶不得被他船拖带,除非是习惯性的或需要协助拖至第一安全港口或地点,也不得根据被保险人、船东、船舶管理人和/或租船人事先安排的合同从事拖带或救助服务,但本款不排除与装卸有关的习惯拖带。   2、 保险船舶用于在海上装卸到另一条船或从另一条船装卸到本船的商业行为(不包括另一在港内的船或近岸的小船),由于此种装卸作业,包括两船驶近、并排停靠和驶离,造成保险船舶的损失或损害以及对他船的责任,本保险不负责赔偿,除非船舶在从事这种作业前,已事先通知了保险人,并且双方同意了修改的承保条件和增加保险费。   3、 如果保险船舶的开航(不论有无载货)旨在(a)拆船或(b)为拆船而出售,那么对保险船舶在如此开航后发生的任何损失或损害,保险人不负责赔偿,除非已事先通知了保险人,并已同意了修改承保条件、保险价值和保险人要求的保险费。   二、延续   本保险期满时,如果保险船舶尚在海上,或在避难中,或在避难港,或在中途港,那么只要事先通知保险人,并按月比例支付超期保险费后,本保险继续负责承保至抵达其目的港为止。   三、违反保证   当任何有关货物、航线、船位、拖带、救助服务或开航日期的保证被违反时,若被保险人接到消息后迅速通知保险人,并同意修改承保条款和加付所需的保险费,则保险仍然有效。   四、终止   本保险的任何条款,不论是手写的、打印的还是印刷的,若与本条相抵触时,均以本条为准。 除非保险人有书面同意相反的规定外,本保险在下列情况下自动终止: 1、保险船舶的船级社变更,或者其船级变更、暂停、中止、撤回或期限届满时,但如果船舶尚在海上航行,该自动终止可延迟至船舶抵达下一个港口时。然而,如果此种船级变更、暂停、中止或撤回是由本保险第6条款承保的损失或损造成的,或者是由根据现行协会船舶战争险和罢工险定期承保条款承保的损失或损害引起的,此种自动终止仅于船舶未经船级社事先同意在下一港口开航时才发生效力。   2、自愿或其他方式变更船舶所有权或船旗、转让给新的管理人、光船出租或被征购、征用时,但如果船上载有货物并已从装货港开航,或在海上空载航行时,经要求,此种船舶自动终止应延迟,直至船舶继续其计划航行,载货船到达最后卸货港时为止,空载船舶到达目的港时为止。但是,如果征购、征用没有事先与被保险人签订书面协议,那么不论船舶是在海上还是在港内,保险责任的终止将在船舶被征购或征用后15天开始生效。 保险费的净收入按日比例退回。 五、转让 对保险利益的转让,或以金钱支付的利益的转让,保险人概不承认,也不受这种转让的约束。但如果被保险人在发生任何索赔或退还保险费之前就在这种转让通告书上注明了日期并签署,以及以后转让人在保险单上背书这种转让,则保险人给予赔偿。   六、危险1、本保险承保由于下列原因所造成的保险标的的灭失或损坏:(1) 海上、江河、湖泊或其他可航水域的灾害; (2) 火灾、爆炸;(3) 来自保险船舶外的人员暴力盗窃;(4) 抛弃货物;(5) 海盗;(6) 核装置或核反应堆发生的故障或意外事故;   (7) 与航空器或类似装置及其从上坠落的物体,和与陆上传送设备、码头、港口设备或装置的触碰; (8) 地震、火山爆发或闪电。 2、本保险承保由于下列原因所造成的保险标的的灭失或损坏: (1) 装卸、移动货物或燃料过程中发生的意外事故; (2) 锅炉破裂、尾轴断裂或机器、船体的任何潜在缺陷; (3) 船长、高级船员 、船员或引航员的疏忽; (4) 被保险人以外的修船人员或承租人的疏忽行为; (5) 船长、高级船员、船员的不法行为。如果此种灭失或损坏并非由于被保险人、船东或管理人缺乏谨慎处理所致。   3、船长、高级船员、船员或引航员对保险船舶拥用股权的,不被视为本条(第6条)意义上的船东。   4、本保险承保:   (1)共同海损、救助和救助费用之根据船壳和机器保险未能全部补偿的部分,其产生是由于保险船舶的保险价值(或在评定索赔过程中按承保船壳和机器保险的法律、惯例或条款要求予以扣减后减少了的价值)低于保险船舶的共同海损、救助或救助费用的分摊价值而存在差额,保险人按照本保险的保险金额与这个差额的比例,或在承保超额责任的保险金额的总和超过这个差额时,按照本保险的保险金额与保险金额的总和比例,支付上述未能补偿的部分。   (2)施救费用之根据船壳和机器保险未能全部补偿的部分,其产生是由于保险船舶的保险价值低于为确定根据船壳和机器保险的补偿额采用的保险船舶价值而存在差额,保险人按照本保险的保险金额与这个差额的比例,或在承保超额责任的保险金额的总和超过这个差额时,按照本保险的保险金额与保险金额的总和的比例,支付上述未能全部补偿的部分。   (3)碰撞责任(3/4)之根据船壳和机器保险中协会3/4 碰撞责任和姐妹船条款未能全部补偿的部分,其产生是由于此种3/4 碰撞责任超过了保险船舶的 3/4 保险金额而存在差额,保险人按照本保险的保险金额与承保超额责任的保险金额的总和的比例,支付上述差额。   5、保险人分别根据第六条4款(1)、(2)和(3)项下的责任,在一次索赔中,不超过本保险的保险金额。   七、污染危险   本保险承保由于任何政府当局以其权力为防止或减轻因保险船舶应由保险人负责的全损直接引起的污染危险或其威胁采取的行动造成的保险船舶全损(实际全损或推定全损),如果政府当局的这种行动不是由于保险船舶的被保险人、船东或管理人或其中任何人在防止或减少此种污染或威胁方面缺乏谨慎处理所致。船长、高级船员、船员或引航员对保险船舶拥有股权的,不被视为在本条(第7条)意义上的船东。   八、索赔通知 在发生意外事故所造成的灭失或损坏可能导致保险赔偿时,被保险人应在船舶检验之前通知保险人,如果船舶在国外,则应通知最近地区的劳合社代理人,以便保险人在认为需要时委派检验人代表保险人进行检验。   九、推定全损   1、在确定保险船舶是否构成推定全损时,船壳和机器保险中的保险价值应作为船舶修理后的价值,不应考虑保险船舶的受损或解体价值或残骸。 2、基于保险船舶的回复和/或修理费用的推定全损索赔不应得到赔偿,除非此笔费用会超过保险价值。在作此项决定时,应仅考虑与单一次事故或由于同一事故引起后续损害赔偿有关的费用。 3、如果船壳和机器保险中包含现行协会船舶定期保险条款的推定全损条款或类似效果的条款,船壳和机器保险争议中协商确定的按推定全损处理应视为保险船舶推定全损的证据。   4、假若保险船舶构成推定全损,但其船壳和机器保险按部分损失处理,保险人根据本条不承担赔偿责任。   十、协议全损   在船壳和机器保险中索赔全损或推定全损而达成按协议达成全损或推定全损的情况下,本保险按船壳和机器保险中相同的赔付比例,支付本保险的保险金额。   十一、停泊和解约时的退费   1、按照下列规定退还保险费:   (1) 本保险经协议同意解除时,每一未开始的月份的净保险费按月比例退还。   (2) 船舶在保险人同意的港内或闲置水域连同下文规定的特别准许停泊时,若每次连续停泊30天,则按下列办法计算退回保险费: (a) 未进行修理的,按 %计算; (b) 进行修理的, 按 %计算;   如果保险船舶修理期间,仅部分时间属于可退费期,退费应分另按照以上(a)、(b)两项中的日数比例计算。 2、 但尚需符合下列条件: (1) 在本保险的保险期间内或其延续期间内未发生保险船舶的全损,不论是否是由承保危险造成的。 (2) 若保险船舶停泊在暴露或无防护的水域,或停泊于未经保险人认可的港口或锚泊水域,则不予退费,但是如果保险人同意将此种未被认可的停泊港口或水域视为在认可的停泊港口或水域的范围内,则在此种未被认可的港口或水域内停泊期间的天数可以加上在认可的港口或水域内的天数以构成一次连续停泊30天,而退费仍限于在认可的港口或水域内停泊天数所占的比例部分。 (3) 装卸作业或船上有货物不应影响退费,但保险船舶被用作储藏或驳运货物的任何期间,不允许退费。 (4) 年保险费率修改时,上述保险费退回率也应作相应的调整。 (5) 根据本条可得到的退费基于连续30天停泊期,包括在同一被保险人投保的数个连续保险时,本保险仅负责按照上述第1款第2项(a)小项或(b)小项规定的退费率对于本保险的保险期间内的实际停泊天数占总停泊天数比例计算出来的退费。被保险人有权选择此种重叠期应自被保险人船舶闲置的第一天开始起算或自上述本条第1款第2项(a)小项或(b)小项或本条第2款第2项规定的连续30天停泊期间的第一天开始起算。   下列各条是首要条款,本保险中任何与下列各条不一致的规定,均属无效。   十二、战争责任免除   在任何情况下,本保险不承保由于下列原因引起的损失、损害、责任或费用: 1、战争、内战、革命、造反、叛乱、或由此引起的内乱,或任何交战方之间的敌对行为; 2、捕获、扣押、扣留、拘禁或羁押(船长或船员的恶意行为和海盗行为除外),以及这些行为所引起的后果或进行这些行为的企图; 3、被遗弃的水雷、鱼雷、炸弹或其他被遗弃的战争武器。   十三、罢工责任免除 在任何情况下,本保险不承保由于下列原因引起的损失、损害、责任或费用: 1、 罢工者,被迫停工工人,或参加工潮、暴乱或民变的人员。 2、 任何恐怖分子或出于政治动机的人员。   十四、恶意行为责任免除 在任何情况下,本保险不承保恶意地或出于政治动机而行为的人员造成的由以下原因引起的损失、损害、责任或费用: 1、 炸药爆炸。 2、 任何战争武器。   十五、核武器责任免除 在任何情况下,本保险不承保由于应用原子或核裂变和/或聚变或其他类似反应或放射力量或物质所制造的战争武器所造成的灭失、损害、责任或费用。   INSTITUTE TIME CLAUSES – HULLS DISBURSEMENTS AND INCREASED VALUE   (Total Loss only, including Excess Liabilities)   This insurance is subject to English law and practice   1. NAVIGATION   1.1 The subject-matter insured is covered subject to the provisions of this insurance at all times and the vessel has leave to sail or navigate with or without pilots, to go on trial trips and to assist and tow vessels or craft in distress, but it is warranted that the vessel shall not be towed, except as is customary or to the first safe port or place when in need of assistance, or undertake towage or salvage services under a contract previously arranged by the Assured and/or Owners and/or Managers and/or Charterers. This Clause 1.1 shall not exclude customary towage in connection with loading and discharging.   1.2 In the event of the vessel being employed in trading operations which entail cargo loading or discharging at sea from or into another vessel (not being a harbour or inshore craft) no claim shall be recoverable under this insurance in respect of loss of or damage to the subject-matter insured or for liability to any other vessel arising from such loading or discharging operations, including whilst approaching, lying alongside and leaving, unless previous notice that the vessel is to be employed in such operations has been given to the Underwriters and any amended terms of cover and any additional premium required by them have been agreed.   1.3 In the event of the vessel sailing (with or without cargo) with an intention of being (a) broken up, or (b) sold for breaking up, no claim shall be recoverable under this insurance in respect of loss or damage to the vessel occurring subsequent to such sailing unless previous notice has been given to the Underwriters and any amendments to the terms of cover, amount insured and premium required by them have been agreed.   2. CONTINUATION   Should the vessel at the expiration of this insurance be at sea or in distress or at a port of refuge or of call, the subject-matter insured shall, provided previous notice be given to the Underwriters, be held covered at a pro rata monthly premium to her port of destination.   3. BREACH OF WARRANTY   Held covered in case of any breach of warranty as to cargo, locality, trade, towage, salvage services or date of sailing, provided notice be given to the Underwriters immediately after receipt of advices and any amended terms of cover and any additional premium required by them be agreed.   4. TERMINATION   This Clause 4 shall prevail notwithstanding any provision whether written typed or printed in this insurance inconsistent therewith.   Unless the Underwriters agree to the contrary in writing, this insurance shall terminate automatically at the time of   4.1 change of the Classification Society of the vessel, or change, suspension, discontinuance, withdrawal or expiry of her Class therein, provided that if the vessel is at sea such automatic termination shall be deferred until arrival at her next port. However where such change, suspension, discontinuance or withdrawal of her Class has resulted from loss or damage which would be covered by an insurance of the vessel subject to current Institute Time Clauses Hulls or Institute War and Strikes Clauses Hulls-Time such automatic termination shall only operate should the vessel sail from her next port without the prior approval of the Classification Society,   4.2 any change, voluntary or otherwise, in the ownership or flag, transfer to new management, or charter on a bareboat basis, or requisition for title or use of the vessel, provided that, if the vessel has cargo on board and has already sailed from her loading port or is at sea in ballast, such automatic termination shall if required be deferred, whilst the vessel continues her planned voyage, until arrival at final port of discharge if with cargo or at port of destination if in ballast. However, in the event of requisition for title or use without the prior execution of a written agreement by the Assured, such automatic termination shall occur fifteen days after such requisition whether the vessel is at sea or in port.   A pro rata daily net return of premium shall be made.   5. ASSIGNMENT   No assignment of or interest in this insurance or in any moneys which may be or become payable thereunder is to be binding on or recognised by the Underwriters unless a dated notice of such assignment or interest signed by the Assured, and by the assignor in the case of subsequent assignment, is endorsed on the Policy and the Policy with such endorsement is produced before payment of any claim or return of premium thereunder.   6. PERILS   6.1 This insurance covers total loss (actual or constructive) of the subject-matter insured caused by   6.1.1 perils of the seas rivers lakes or other navigable waters   6.1.2 fire, explosion   6.1.3 violent theft by persons from outside the vessel   6.1.4 jettison   6.1.5 piracy   6.1.6 breakdown of or accident to nuclear installations or reactors   6.1.7 contact with aircraft or similar objects, or objects falling therefrom, land conveyance, dock or harbour equipment or installation   6.1.8 earthquake volcanic eruption or lightning.   6.2 This insurance covers total loss (actual or constructive) of the subject-matter insured caused by   6.2.1 accidents in loading discharging or shifting cargo or fuel   6.2.2 bursting of boilers breakage of shafts or any latent defect in the machinery or hull   6.2.3 negligence of Master Officers Crew or Pilots   6.2.4 negligence of repairers or charterers provided such repairers or charterers are not an Assured hereunder   6.2.5 barratry of Master Officers or Crew,   provided such loss or damage has not resulted from want of due diligence by the Assured, Owners or Managers.   6.3 Master Officers Crew or Pilots not to be considered Owners within the meaning of this Clause 6 should they hold shares in the vessel.   6.4 This insurance covers:   6.4.1 General Average, Salvage and Salvage Charges not recoverable in full under the insurances on hull and machinery by reason of the difference between the insured value of the vessel as stated therein (or any reduced value arising from the deduction therefrom in process of adjustment of any claim which law or practice or the terms of the insurances covering hull and machinery may have required) and the value of the vessel adopted for the purpose of contribution to general average, salvage or salvage charges, the liability under this insurance being for such proportion of the amount not recoverable as the amount insured hereunder bears to the said difference or to the total sum insured against excess liabilities if it exceed such difference.   6.4.2 Sue and labour Charges not recoverable in full under the insurances on hull and machinery by reason of the difference between the insured value of the vessel as stated therein and the value of the vessel adopted for the purpose of ascertaining the amount recoverable under the insurances on hull and machinery, the liability under this insurance being for such proportion of the amount not recoverable as the amount insured hereunder bears to the said difference or to the total sum insured against excess liabilities if it exceed such difference.   6.4.3 Collision Liability (three-fourths) not recoverable in full under the Institute 3/4ths Collision Liability and Sistership Clauses in the insurances on hull and machinery by reason of such three-fourths liability exceeding three-fourths of the insured value of the vessel as stated therein, in which case the amount recoverable under this insurance shall be such proportion of the difference so arising as the amount insured hereunder bears to the total sum insured against excess liabilities.   6.5 The Underwriters' liability under 6.4.1, 6.4.2 and 6.4.3 separately, in respect of any one claim, shall not exceed the amount insured hereunder.   7. POLLUTION HAZARD   This insurance covers total loss (actual or constructive) of the vessel caused by any governmental authority acting under the powers vested in it to prevent or mitigate a pollution hazard, or threat thereof, resulting directly from damage to the vessel caused by a peril covered by this insurance, provided such act of governmental authority has not resulted from want of due diligence by the Assured, the Owners, or Managers of the vessel or any of them to prevent or mitigate such hazard or threat. Master, Officers, Crew or Pilots not to be considered Owners within the meaning of this Clause 7 should they hold shares in the vessel.   8. NOTICE OF CLAIM   In the event of accident whereby loss or damage may result in a claim under this insurance, notice shall be given to the Underwriters prior to survey and also, if the vessel is abroad, to the nearest Lloyd's Agent so that a surveyor may be appointed to represent the Underwriters should they so desire.   9. CONSTRUCTIVE TOTAL LOSS   9.1 In ascertaining whether the vessel is a constructive total loss, the insured value in the insurances on hull and machinery shall be taken as the repaired value and nothing in respect of the damaged or break-up value of the vessel or wreck shall be taken into account.   9.2 No claim for constructive total loss based upon the cost of recovery and/or repair of the vessel shall be recoverable hereunder unless such cost would exceed the insured value in the insurances on hull and machinery. In making this determination, only the cost relating to a single accident or sequence of damages arising from the same accident shall be taken into account.   9.3 Provided that the Constructive Total Loss Clause in the current Institute Time Clauses Hulls or a clause having a similar effect is contained in the insurances on hull and machinery, the settlement of a claim for constructive total loss thereunder shall be accepted as proof of the constructive total loss of the vessel.   9.4 Should the vessel be a constructive total loss but the claim on the insurances on hull and machinery be settled as a claim for partial loss, no payment shall be due under this Clause 9.   10. COMPROMISED TOTAL LOSS   In the event of a claim for total loss or constructive total loss being settled on the insurances on hull and machinery as a compromised total loss the amount payable hereunder shall be the same percentage of the amount insured as is paid on the said insurances.   11. RETURNS FOR LAY-UP AND CANCELLATION   11.1 To return as follows:   11.1.1 Pro rata monthly net for each uncommenced month if this insurance be cancelled by agreement.   11.1.2 For each period of 30 consecutive days the vessel may be laid up in a port or in a lay-up area provided such port or lay-up area is approved by the Underwriters (with special liberties as hereinafter allowed)   (a) {Response} per cent net not under repair   (b) {Response} per cent net under repair.   If the vessel is under repair during part only of a period for which a return is claimable, the return shall be calculated pro rata to the number of days under (a) and (b) respectively.   11.2 PROVIDED ALWAYS THAT   11.2.1 a total loss of the vessel, whether by insured perils or otherwise, has not occurred during the period covered by this insurance or any extension thereof   11.2.2 in no case shall a return be allowed when the vessel is lying in exposed or unprotected waters, or in a port or lay-up area not approved by the Underwriters but, provided the Underwriters agree that such non-approved lay-up area is deemed to be within the vicinity of the approved port or lay-up area, days during which the vessel is laid up in such non-approved lay-up area may be added to days in the approved port or lay-up area to calculate a period of 30 consecutive days and a return shall be allowed for the proportion of such period during which the vessel is actually laid up in the approved port or lay-up area   11.2.3 loading or discharging operations or the presence of cargo on board shall not debar returns but no return shall be allowed for any period during which the vessel is being used for the storage of cargo or for lightering purposes   11.2.4 in the event of any amendment of the annual rate, the above rates of return shall be adjusted accordingly   11.2.5 in the event of any return recoverable under this Clause 11 being based on 30 consecutive days which fall on successive insurances effected for the same Assured, this insurance shall only be liable for an amount calculated at pro rata of the period rates 11.1.2 (a) and/or (b) above for the number of days which come within the period of this insurance and to which a return is actually applicable. Such overlapping period shall run, at the option of the Assured, either from the first day on which the vessel is laid up or the first day of a period of 30 consecutive days as provided under 11.1.2 (a) or (b), or 11.2.2 above.   The following clauses shall be paramount and shall override anything contained in this insurance inconsistent therewith.   12. WAR EXCLUSION   In no case shall this insurance cover loss damage liability or expense caused by   12.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power   12.2 capture seizure arrest restraint or detainment (barratry and piracy excepted), and the consequences thereof or any attempt thereat   12.3 derelict mines torpedoes bombs or other derelict weapons of war.   13. STRIKES EXCLUSION   In no case shall this insurance cover loss damage liability or expense caused by   13.1 strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions   13.2 any terrorist or any person acting from a political motive.   14. MALICIOUS ACTS EXCLUSION   In no case shall this insurance cover loss damage liability or expense arising from   14.1 the detonation of an explosive   14.2 any weapon of war and caused by any person acting maliciously or from a political motive.   15. NUCLEAR EXCLUSION   In no case shall this insurance cover loss damage liability or expense arising from any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.   14. 船舶保险附加保障赔偿保险(B)条款   一、承保责任   本公司根据本条款承保被保险人的下列责任、损失和费用:   (一)人身伤亡和疾病   1.由于被保险船舶及其雇佣人员的过失或疏忽行为而引起的应由被保险人负责的人身伤亡、疾病的补偿。   2.根据法律或契约规定应由被保险人负责的(与被保险船舶有关的)人身伤亡、疾病的补偿。   3.根据法律或契约规定应由被保险人负责的被保险船舶上的船长、船员或替工由于人身伤亡、疾病所发生的住院、医药和丧葬费用(包括船长、船员或替工由于受伤或疾病暂时离开被保险船舶的费用)。   (二)遣返、派遣及其他费用   1.根据法律或契约规定应由被保险人负责的被保险船舶上船长、船员的遣返或替工的派遣和遣返的费用。   2.根据法律或契约的规定应由被保险人负责的被保险船舶上的船长、船员,在海外医疗和遣返期间的工资,海外替工在等待遣返和遣返期间的工资和被保险船舶全损、或沉没后应付给船长、船员的工资。   3.根据法律或契约规定应由被保险人负责的为救助被保险船舶上的遇险船员费用和船员在海难中衣服、行李的损失。   4.为处理偷乘人员或送被保险船舶上的伤员上岸进行医疗而产生的港口费用及其他必要费用。   (三)碰撞及污染责任   1.(1)由于被保险船舶漏油或其混合物污染沿海或可能产生严重危害污染沿海,被保险人采取合理措施,清除漏油或其混合物而支出的费用以及(2)被偿有关政府清除被保险船舶有任何程度过失所致的漏油或其混合物而合理支出的费用。   2.由于被保险船舶漏油或其混合物造成对第三者的污染损害,被保险人在法律上应负责支付的赔偿。   3.根据法律规定应予负责的,或由于被保险船舶航行或管理上的疏忽,或与被保险船舶有关的任何其他疏忽行为,或失检而造成的其他的船舶或其财产(包括有关费用和杂费),任何固定的和浮动的物体、陆地或水的灭失或损坏,但在任何情况下,本条款责任不包括本公司船舶险条款第一条第(2)款规定可以取得赔偿的此类损失及费用。   本公司对油污索赔责任,每一事故最高以______美元为限。   (四)由于被保险船舶过失或疏忽行为而引起的应由被保险人负责的非碰撞责任造成其他船舶和船舶上财产或货物的损失。   (五)应由被保险人负责的被保险船舶按照拖带契约在被拖带时所引起的损失。   (六)根据被保险人所签订的保证或合同规定应由被保险人负责的人身伤亡、疾病或任何货物或财产的损失(但该保证或合同以保险公司书面同意的为限)。   (七)为被保险船舶残体或障碍物建立标灯或标记和清除这种残体或障碍物所需的费用(扣除残体)。   (八)由于发生疫病对被保险船舶或船上人员进行消毒所引起的检疫费用和其他费用。   (九)当被保险人和由其代负法律责任的人作为海运承运人,由于违返谨慎地收受、装载、承运、保管、照料、卸载及交付货物或财产的应尽义务或由于被保险船舶不适航或装备不良而造成货物或其他财产的损失和费用。   (十)由于被保险船舶违反运输契约而不能向货方收取的共同海损分担、特别费用或救助费用。   (十一)由于被保险船舶的分担价值高于保险价值而不能在船舶险保单项下获得赔偿的共同海损分担、特别费用或救助费用。   (十二)由于被保险船舶短卸、多卸,违反海关章程或船长、船员过失或疏忽行为所引起的罚款。但由于被保险船舶走私或超载而被罚款及其有关法律费用,在任何情况下,本公司均不负责。   (十三)被保险船舶由于进行海事调查和被政府、港口有关当局扣留所引起的费用。   (十四)被保险人支付的与本保单承保责任范围有关的各项费用,包括法律费用和施救费用。但事先应征得本公司同意。   二、权利转让   被保险人要求赔偿损失时,如涉及第三者责任,应将向第三者追偿的权利和必要的证件移交给本公司。   三、争议的处理   被保险人和本公司之间所发生的一切争议,应根据实事求是、公平合理的原则,友好协商解决。如经协商仍不能解决,需要仲裁或诉讼时,仲裁或诉讼的地点在被告方所在地。   四、责任免除   本公司不负责下列责任、损失和费用。   (一)被保险船舶包括家具、船上装饰、器具、储备、燃料、器材设备等损失;   (二)被保险船舶的延期停泊费用和其他间接费用;   (三)取消船舶租约所引起的费用;   (四)提单规定的免辖责任;   (五)本公司船舶险保单的责任;   (六)本公司船舶战争险条款承保的和除外的责任。   1.Scope of Liability   The Company shall be liable for the liabilities, losses or expenses in pursuance of the following clauses:   (1) Compensation for loss of life of or personal injury to or illness of : (a) Any person arising from the fault or negligence of the insured ship and all persons employed by her, for which the Insured shall be liable.   (b) Any person, for which the Insured shall be liable under statute or contract in relation to the insured ship.   (c) Hospital, medical or funeral expenses incurred under statute or contract in consequence of loss of life of ,or personal injury to or illness of the muster, crew members on board the insured ship or any substitute for or replacement of crew members of the insured ship including expenses incurred in consequence of the master, any crew member or substitute being, by reason of injury or illness, temporarily removed from the insured ship.   (2) Repatriation, dispatching and other expenses:   (a) Expenses incurred for repatriating the master or crew members and repatriating or sending substitutes therefore, for which the Insured shall be liable under statute or contract.   (b) Wages of the master or crew members of the insured ship during medical treatment abroad or during repatriation, wages payable to substitutes engaged abroad while awaiting and during repatriation and wages payable to the master or crew members after the total loss or sinking of the insured ship, for which the Insured shall be liable under statute or contract.   (c) Expenses for the relief of distressed crew members of the insured ship, for which the Insured shall be liable under statute or contract and loss of personal effects of the crew members caused by marine perils.   (d) Port and other indispensable expenses incurred for the purpose of disposing of stowaways or securing treatment ashore of any injured or sick persons on board the insured ship.   (3) Collision and pollution liability:   (a) (i) Costs and expenses which the Insured may incur for taking reasonable measures to remove oil or oily mixture discharged from the insured ship if the oil or oily mixture causes damage by pollution to coast line or may create a grave and imminent danger of pollution thereto, and/or (ii)costs and expenses reimbursed to the Government conceded which have been reasonably incurred for cleaning up the oil or oily mixture discharged through the negligence to any degree of the insured ship. (b) Compensation payable by the Insured to any other persons who sustain pollution damage as a result of a discharge of oil or oily mixture from the insured ship, for which the Insured is legally liable.   (c) Loss of or damage to any other ship or any property thereon (and costs and expenses incidental thereto), fixed and floating objects whatsoever, land or water if the liability for such loss or damage is imposed by statute or arose out of the negligent navigation or management of the insured ship of other negligent act or omission on broad of or in relation to the insured ship, but in no case shall this insurance cover liability for such loss, damage or expense as are recoverable under article I. 2 of the Hull Clauses of the Company.   It is specifically agreed that the company's maximum liability shall be USD100, 0000, 000 for oil pollution claims any one accident or occurrence.   (4) Loss or damage to other ships or property or cargo therein occasioned otherwise than by collision with the insured ship and arising from the fault or negligence of the insured ship for which the insured shall be liable.   (5) Loss or damage arising from or during the course of towage of the insured ship, for which the insured shall be liable under the towage contract.   (6) Loss of life of or personal injury to or illness of any person, or loss of or damage to any property or cargo, for which the Insured shall be liable under the terms of any indemnity or contract signed by the Insured provided that the terms of such indemnity or contract shall have been approved in writing by the Company. (7) Expenses of removal, lighting or marking of the wreck of the wreck of the insured ship or obstruction after deduction of the proceeds thereof.   (8) Quarantine and other expenses arising from disinfections of the insured ship or of persons on board her following the outbreak of infections disease upon the insured ship.   (9) Loss of or damage to the cargo or other property and incidental expenses arising from any breach by the Insured or by any person for whose acts, negligence or fault he may be legally liable of his obligation or duty as a carrier by sea properly to receive, load, handle, stow, carry, keep, care for, discharge and deliver such cargo or property, or out of unseaworthiness or unfitness of the insured ship. (10) Cargo's proportion of general average, special charges or salvage not recoverable by reason of a breach of the contract of carriage on the part of the insured ship.   (11) Ship's proportion of general average, special charges or salvage not recoverable under the hull policies of the Company by reason of the value of the insured ship being assessed for contribution to general average or salvage exceeding the insured value under the hull policies.   (12) Fines imposed upon the Insured in respect of the insured ship for short or over delivery of cargo, or for failure to comply with Customs regulations, or for any fault or negligence of the master or crew members.   It is specifically agreed that the Company shall in no circumstances indemnify the Insured against a fine imposed upon him for the smuggling by or overloading of the insured ship or against the legal expenses relating thereto.   (13) Costs and expenses incurred by the insured ship for the purpose of carrying out investigation into a marine casualty and arising from the arrest of the insured ship by any Government, port or other local authorities.   (14) Costs and expenses including legal expenses and sue and labour charges in respect of any liability or expenditure covered under this insurance provided that the same have been incurred with the prior consent of the company.   2. Subrogation of Rights   In submitting his claims, the Insured shall, in case third party liability is involved, subrogate the right of recovery from the third party and transfer the necessary documents to the Company.   3.Treatment of Disputes   All disputes between the Insured and the Company shall be settled by amicable negotiation on the principle of seeking truth from facts and of famines and reasonableness. Where a settlement fails after negotiation and it is necessary to submit to arbitration or take legal actions, such arbitration or legal actions shall be carried out at the place where the defendant is domiciled.   4. Exclusions   The Company shall not be liable for   (1) Loss of or damage to the insured ship including rigging, fittings, furniture, stores, bunkers and equipment etc.   (2) Demurrages of the insured ship and other indirect expenses.   (3) Expenses arising from the cancellation of charter party.   (4) Liabilities exempted from the provisions of the bill of lading.   (5) Protection provided under hull policies of the Company.   (6) Risks covered under and excluded from the Hull War Risks Clauses of the Company.   15. 船舶保险附加油污和其他保赔责任保险条款   一、责任范围   本公司根据本条款规定对被保险人支付下述损失或费用:   (一)1.由于被保险船舶漏油或其混合物污染沿海或可能产生严重危险污染沿海,被保险人采取合理措施清除漏油或其混合物而支出的费用以及。2.补偿有关政府清除被保险船舶有任何程度过失所致的漏油或其混合物而合理支出的费用。   (二)由于被保险船舶漏油或其混合物造成对第三者的污染损害,被保险人在法律上应负责支付的赔偿。   (三)根据法律规定应予负责的或由于被保险船舶航行或管理上的疏忽,或与被保险船舶有关的任何其他疏忽行为,或失检而造成的其他的船舶或其财产(包括有关费用和杂费),任何固定的和浮动的物体、陆地或水的灭失或损坏,但在任何情况下,本条款责任不包括本公司船舶险条款第一条第(2)款规定可以取得赔偿的此类损失及费用。   (四)根据法律规定被保险人对被保险船只残骸的起浮、清除、破坏、建立标灯或标记所支出的成本费用或者被保险人在法律上应予承担的此类费用。但获救物料与残骸价值应首先自上述费用中扣除,本公司仅对其不足之数予以赔偿。被保险人出售残骸,必须事先征得本公司同意。   (五)由于被保险人,作为海运承运人或其他应由被保险人代负疏忽过失法律责任的人,违反谨慎地装载、收受、配载、承运、保管、照料、卸载及交付货物或财产的应尽义务,或由于被保险船舶不适航和装备不良而造成其待装、装运中或已装货物或其他财产的损失。但每一装货航次的赔付额中,被保险人应自负1,000美元。   (六)任何法院、法庭或司法当局所判决的应由被保险船舶担负的各项罚款或罚金。   但被保险人对油污罚款每事故应自负500美 元。其他罚款每一港口应自负500美 元。本公司对被保险人关于被保险船只由于超载而引起的罚金罚款以及有关的法律费用不予负责赔偿。   (七)被保险人因涉及本条款承保责任或开支或为避免该项责任或开支而支付的费用,包括法律费用在内。   本公司对油污索赔责任,每一事故最高以100,000,000美 元为限。对其他索赔的最高责任每一事故(或第(五)项规定的每货运航次)为35,000,000美元。   二、除外责任   本公司对下列各项,不予负责赔偿:   (一)由于船东的故意行为所造成的损失;   (二)被保险船舶的船壳和机件的正常维修、油漆费用和本身磨损或锈蚀;   (三)本公司船舶战争险条款规定的承保责任和除外责任;   (四)滞期损失。   三、保险期限   期限最高一年,以保单规定的起止时间为准。   被保险船舶在保险期限内出售或转让时,除本公司书面同意的外,保险责任立即终止。如果被保险船舶在航程途中出售或转让,保险责任可延至该航程终了时止。   如被保险船舶已构成实际全损或推定全损,本保险即行终止,但对于导致此项实际或推定全损的事故所直接造成的责任则不在此限。   四、退费   (一)被保险船舶在保险期限内出售、转让或退保,保险费按日比例计算退还给被保险人。   (二)被保险船舶在安全港口内边疆停泊超过三十天时(停泊期间自到达日起算至离港日,但应扣除一天)按日比例计算给予下列停泊退费:   船上无船员无货物按95%退费。   但本公司有权保留按年费率每一登记总吨______美元计算的最低保费。   五、损失处理   (一)被保险船舶发生保险责任范围内的事故时,被保险人应立即通知本公司,并采取一切可能措施以减少损失。   被保险人对被保险船舶应定期做好维修和保养,使之处于良好的技术状态。   (二)被保险人要求赔偿时,如涉及第三者责任,应将向第三者追偿的权利和必要的证件移交给本公司。   六、争议的处理   被保险人和本公司之间所发生的一切争议,应根据实事求是的原则,友好协商解决,如经协商仍不得解决,需要仲裁或诉讼时,仲裁或诉讼的地点在被告方所在地。   1. Scope of Cover   It is agreed that the Company shall, subject to the provisions of these Clauses, pay to the Insured all sums in respect of the following losses, damages and expenses:   (1) (a) Costs and expenses which the Insured may incur for taking reasonable measures to remove oil or oily mixture discharged from the insured vessel if the oil or oily mixture causes damage by pollution to coast line or may create a grave and imminent danger of pollution thereto, and/or (b) costs and expenses reimbursed to the Government which have been reasonable incurred for cleaning up the oil or oily mixture discharged through the negligence to any degree of the insured vessel. (2) Compensation payable by the Insured to any other persons who sustain pollution damage as a result of a discharge of oil or oily mixture from the insured vessel, for which the Insured is legally liable.   (3) Loss of or damage to any other vessel or any property thereon (and costs and expenses incidental thereto) fixed and floating objects whatsoever, land or water if the liability for such loss or damage is imposed by statute or arose out of the negligent navigation or management of the insured vessel or other negligent act or omission on board of or in relation to the insured vessel, but in no case shall this insurance cover liability for such loss, damage or expense as are recoverable under article I. 2. of the HullClauses of the Company.   (4) Costs and expenses of or incident to the raising, removal ,destruction, lighting or marking of the wreck of the insured vessel, when such raising, removal, destructions, lighting or marking is compulsory by law or the costs thereof are legally recoverable from the Insured provided that the value of all stores and materials saved as well as of the wreck itself shall first be deducted from such costs, charges and expenses, and only the balance thereof, if any, shall be recoverable from the Company. It is warranted that the Insured shall not transfer his interest in the wreck without the prior consent of the Company.   (5) Loss of cargo or other property to be or being or having been carried in the insured vessel, subject to a deductible of USD 1,000 each cargo voyage, arising out of any breach by the Insured or by any person for whose acts, neglect or default he may be legally liable of his obligation or duty as a carrier by sea properly to load, handle, stow, carry, keep, care for, discharge and deliver such cargo or property, or out of unseaworthiness or unfitness of the insured vessel.   (6)Fines or penalties imposed, subject to a deductible of USD 500 each oil pollution accident and USD 500 each port for fines and penalties of other nature upon the Insured in respect of the insured vessel by any court, tribunal or authority of competent jurisdiction, nevertheless, the Company shall in no event indemnify the Insured against a fine or penalty imposed upon him for the overloading of the insured vessel or against the legal cost and expenses relating thereto.   (7) Costs and expenses, including legal costs and charges, which the Insured may incur in respect of (or in avoiding or attempting to avoid) any liability or expenditure against which the Insured is insured by these Clauses.   It is specifically agreed that the Company's maximum liability shall be USD 100,000,000 for oil pollution claims any one accident or occurrence and USD 35,000,000 for all other claims any one accident or occurrence (or per cargo voyage under paragraph (5) hereof).   2. Exclusions   The Company shall not be liable for   (1) Loss or damage caused by intentional act of the shipowner;   (2) Maintenance repairs to the hull and machinery of the insured vessel, expenses for painting, wear and tear and corrosion;   (3) Risks covered and excluded in the Hull War Risks Clauses of the Company;   (4) Demurrage of the insured vessel.   3. Period of Insurance   The longest duration is one year subject to the time of commencement and termination as stipulated in the Policy.   In the event that the insured vessel is sold or transferred during the currency of insurance, the insurance shall become terminated forthwith unless such sale or transfer is agreed to by the Company in writing. Where the insured vessel is sold or transferred in the course of a voyage, the insurance may be extended until the completion of such voyage.   Should the insured vessel become an actual or constructive total loss this insurance shall cease save for liabilities flowing directly from the casualty giving rise to such actual or constructive total loss.   4. Return of Premium   (1) If the insured vessel is sold or transferred or the insurance thereon is cancelled during the currency of insurance, a return premium to be calculated pro rata daily shall be allowed to the Insured.   (2) If the insured vessel is laid up in a safe port for a period exceeding thirty consecutive days (such period being computed from the day of arrival to the day of departure, one only being excluded), a return premium, to be calculated pro rata daily for the period during which the insured vessel is laid up, shall be allowed at the following rates:   95%-with neither crew nor cargo on board provided that the Company shall always be entitled to retain a minimum premium at an annual rate of USD ______per gross registered ton.   5. Treatment of Loss   (1) In the event of accidents to the insured vessel which fall under the scope of cover, the Insured shall notify the Company immediately and take all possible measures to minimize the loss.   The Insured shall cause the insured vessel to undergo periodic overhaul and repairs and be well kept, so as to make her in good technical condition.   (2) In submitting his claim, the Insured shall, in case third party liability is involved, subrogate the right of recovery from the third party and transfer the necessary documents to the Company.   6. Treatment of Disputes   All disputes arising between the Insured and the Company shall be settled by friendly negotiation of the principle of seeking truth from facts and of fairness and reasonableness. Where a settlement fails after negotiation and it is necessary to submit to arbitration or take legal actions, such arbitration or legal actions shall be carried out at the place where the defendant is domiciled.
